Bentley + Lace Preferred Photographer & Gown Testing Collaboration Program — Terms of Agreement

These Terms of Agreement (“Agreement”) outline the expectations, responsibilities, and guidelines for all participants (“Photographer” or “Collaborator”) accepted into the Bentley + Lace Preferred Photographer & Gown Testing Collaboration Program (“Program”) operated by Bentley + Lace LLC (“Company,” “we,” or “us”).
By applying for and participating in this Program, you acknowledge that you have read, understood, and agree to comply with the following terms.
1. Purpose of the Program
The Program is designed to build a community of professional photographers who partner with Bentley + Lace to create editorial-quality images featuring our couture and rental gowns. Selected collaborators may receive discounts, affiliate commissions, and promotional features in exchange for delivering approved photo content that aligns with the Bentley + Lace brand aesthetic.
2. Eligibility
- Participants must be at least 18 years of age and reside within the United States.
- Photographers must maintain a professional portfolio and have consistent communication and follow-through.
- Acceptance into the Program is at the sole discretion of Bentley + Lace and may be revoked at any time for failure to comply with these terms.
3. Collaboration Expectations
Photographers agree to:
- Use Bentley + Lace gowns only for agreed-upon creative sessions or campaigns.
- Style, photograph, and deliver high-resolution images in line with the Company’s fine-art, editorial, and family-friendly brand style.
- Submit a minimum of [X] edited images per gown within 14 business days of the photoshoot.
- Tag and credit @bentleyandlace on all social media posts, stories, and marketing usage of the images.
- Provide Bentley + Lace with permission to use submitted imagery across all digital and print platforms (including but not limited to social media, website, advertisements, and email marketing).
4. Image Rights & Usage
- Photographer retains copyright ownership of the images but grants Bentley + Lace a perpetual, non-exclusive, royalty-free license to use, edit, crop, or adapt the images for marketing, promotional, and commercial purposes.
- Bentley + Lace agrees to credit the Photographer whenever reasonably possible in online and print usage.
- Photographers may not resell or redistribute images featuring Bentley + Lace gowns to third parties without prior written consent.
5. Gown Care and Return Policy (for Gown Testing)
If a physical gown is provided for testing:
- The Photographer is responsible for proper care, handling, and timely return of the gown.
- Gowns must be returned in the same condition received, free of stains, damage, or alterations.
- Any damage beyond normal wear may result in a repair or replacement fee.
- Gowns must be shipped back using the provided return label within five (5) business days after the session unless otherwise arranged.
6. Discount and Commission Structure
Active Program members receive:
- 35% off gown rentals
- 10% off custom orders
- 20% off remnant gowns
- 10% off ready-to-ship gowns
5% commission on completed orders referred through their unique discount or affiliate link- Special discount codes for sharing with followers, clients, and family
Discounts and commissions are privileges contingent on active participation, compliance, and consistent engagement with Bentley + Lace social and promotional activities.
7. Content Delivery & Deadlines
- Edited gallery delivery must occur within the timeline outlined in Section 3.
- Delays or failure to deliver content may result in removal from the Program or loss of future collaboration opportunities.
- Late delivery may also forfeit the right to receive future discounts or affiliate earnings.
8. Communication & Conduct
- Professional, respectful communication is required at all times.
- Photographers agree to maintain a positive, brand-aligned public presence when representing Bentley + Lace.
- Discriminatory, harassing, or unprofessional behavior will result in immediate termination from the Program.
9. Termination
Bentley + Lace reserves the right to terminate participation in the Program at any time, with or without cause. Reasons may include (but are not limited to) failure to communicate, missed deadlines, misuse of gowns, or violation of brand standards.
10. Liability
Bentley + Lace is not liable for any injury, loss, or damage arising from use of gowns or participation in the Program. Photographers assume all risk associated with photoshoots and the handling of gowns.
11. Independent Contractor Relationship
Participation in the Program does not create an employment, partnership, or agency relationship. Photographers act as independent contractors responsible for their own business operations, taxes, and insurance.
12. Agreement & Acceptance
By submitting both required application forms and/or participating in any collaboration with Bentley + Lace, you confirm that you have read, understood, and agreed to this Terms of Agreement.
